Withdrawal from the contract
If you are a consumer, you have the right to withdraw from a remote contract.
You can withdraw from the contract by submitting to us a declaration of withdrawal from the contract, e.g. by e-mail sent to the following address: info@formyca.de
Return the returned item to us immediately at the following address: ul. Hebanowa 18B, 87-100 Toruń, but no later than within 14 days from the date on which you withdrew from the contract.
You can withdraw from the contract within 14 days.
The fourteen-day period for withdrawal from the contract begins:
- for a contract in which we deliver an item and are obliged to transfer its ownership – from the time you take possession of the item or a third party other than the carrier indicated by you,
- for digital content – from the date of conclusion of the contract.
To meet the deadline, it is enough to send the declaration before its expiry.
We will refund the payments you have made, including the costs of delivering the items in accordance with the terms set out in the regulations, immediately, but no later than within 14 days from the date of receipt of your declaration of withdrawal from the contract.
We may withhold the refund of the payment received from you until we receive the item back or you provide proof of sending it back, depending on which event occurs first.
Remember that the consumer is not entitled to withdraw from a distance contract etc. in relation to the contract:
- in which the object of performance is a non-refabricated item, produced to the consumer's specifications or serving to meet his individualized needs,
- in which the subject of the service is an item subject to rapid deterioration or having a short shelf life,
- in which the subject of the service is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if the packaging was opened after delivery,
- in which the subject of the service are sound or visual recordings or computer programs delivered in a sealed package, if the packaging has been opened after delivery
- for the provision of digital content that is not recorded on a tangible medium, if the performance of the service began with the express consent of the consumer before the deadline for withdrawal from the contract and after the entrepreneur informed him about the loss of the right to withdraw from the contract. Complaints
If you are a consumer, if the goods purchased from us turn out to be defective, you have the right to make a complaint based on the warranty. It is best to submit a complaint to the following e-mail address: info@formyca.de or by post to ul. Hebanowa 18B, 87-100 Toruń.

Due to the defect, you can request:
- exchanging items for ones free from defects,
- removal of the defect,
or submit a statement about:
- price reduction,
- withdrawal from the contract – in the event of a significant defect.
We are liable to you for defects discovered within two years from the date of delivery of the item.
As a rule, you can submit a complaint within one year of noticing the defect, but the time for filing a complaint cannot end before the seller's liability period expires.
Your complaint will be considered (response to it) within 14 days from the date of our receipt of your complaint.
